Your Perfect Holiday Checklist Sweepstakes Official Rules NO PURCHASE NECESSARY TO ENTER OR WIN ELIGIBILITY The 'Your Perfect Holiday Checklist Sweepstakes' ("Sweepstakes") runs between 12:01 AM Eastern Standard Time (“EST”) on October 24, 2008 and 11:59 PM EST on December 19, 2008. Open to legal residents of the 50 United States and the District of Columbia, age 21 and older. Employees of The Orvis Company, eBags Inc., 1-800-Flowers.com, Paul Fredrick MenStyle, The Thompson Group, Omaha Creative Group ("Sponsors"), Vibe Incentives and their respective parents, affiliates, subsidiaries, advertising and promotional agencies and the immediate family members of each are not eligible to enter the Sweepstakes. Sweepstakes is void wherever prohibited or restricted by law and is subject to all applicable federal, state, and local laws. HOW TO ENTER ONLINE SWEEPSTAKES REGISTRATION: Follow the instructions at one of the participating Sponsor Web sites at <web sites here> to complete the Sweepstakes registration form to receive one (1) entry. Only one (1) entry per person for the duration of the Sweepstakes. Entry must be received by December 19, 2008 11:59PM EST to qualify for entry into the Sweepstakes. No other method of entry will be accepted. Proof of online entry or of posting does not constitute proof of delivery. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. All entries become the property of Sponsors and will not be acknowledged or returned. Non-winning entries for the Weekly Prize Drawings will be entered into subsequent drawings and the Grand Prize Drawing. Approximate retail value of Grand Prize is $450.00. Grand Prize winner will be selected on or about December 22, 2008. Approximate retail value of all prizes is $4,650.00. All taxes and all other expenses not expressly specified herein as part of the prizes are the sole responsibility of the winners. Prizes are non-transferable and may not be substituted or redeemed for cash. Restrictions may apply on any prize. Sponsors reserve the right to substitute a prize for one of equal or greater value. No more than one prize per entrant. Prize details not specifically set forth herein are at Sponsors’ sole discretion. Winner is solely responsible for any costs incurred in claiming, registering, or using a prize. All federal, state, local, municipal laws and regulations apply. WINNER SELECTION/NOTIFICATION All potential winners will be selected for all prizes by an independent judging organization in a random drawing from among all eligible entries. Potential winners will be notified by email and/or phone within 10 days from the DRAWING date. In the event that a potential winner cannot be notified within 10 days after notification attempt, or does not reply within 10 days to the notification attempt, or if a potential winner fails to comply with any requirement of these Official Rules, then that potential winner’s prize will be forfeited, and an alternate potential winner may be selected at random from the remaining eligible entries received. Prizes will be awarded within 30 days of Winners’ acceptance of prize. Odds of winning depend on the number of eligible entries received. AGREEMENT TO OFFICIAL RULES By entering the Sweepstakes, each entrant fully and unconditionally agrees to be bound by these Official Rules and by the decisions of the independent judging organization which are final on all matters pertaining to the Sweepstakes. The Sweepstakes is governed by the laws of the state of Washington, whose courts shall have non exclusive jurisdiction in respect of any dispute arising. PUBLICITY Participation in the Sweepstakes constitutes each winner’s permission for Sponsors to use such winner's name, likeness, hometown and biographical information for advertising and promoting this Sweepstakes without additional compensation unless prohibited by law. RELEASE By entering the Sweepstakes, each entrant fully and unconditionally releases and holds harmless Sponsors, Vibe Incentives and their parents, affiliates, subsidiaries, directors, officers, employees and its advertising, promotional and judging agencies from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Sweepstakes or receipt, redemption, use or misuse of any prize won, except to the extent that this release may be limited by applicable law. GENERAL Entries generated by a script, macro, or other automated means will be disqualified. Sponsors, any telephone network, service providers and Vibe Incentives are not responsible for any problems or technical malfunction of any telephone network or lines, incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any Web site or on-line service, or any other error or malfunction, or late, lost, illegible or misdirected entries. Entry materials that have been tampered with or altered are void. If the judges determine, in their sole discretion, that there is any suspected or actual electronic tampering with the Sweepstakes or if technical difficulties compromise the integrity of the Sweepstakes, the judges reserve the right to void the entries at issue and/or terminate the Sweepstakes and conduct a random drawing to award the prizes among all eligible entries received as of the termination date. If the Sweepstakes is terminated due to tampering or technical difficulties prior to its expiration date, notice will be posted at www.vibeincentives.com/holiday. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsors reserve the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. Sponsors reserve the right to disqualify any entrant that tampers with the operation of the Sweepstakes or website or violates the Official Rules of the Sweepstakes.
